"A Republican Congress enacted the Defense of Marriage Act, affirming the right of states not to recognize same sex 'marriages' licensed in other states. Un-believably, the Democratic Party has now pledged to repeal the Defense of Marriage Act, which would subject every state to the redefinition of marriage by a judge without ever allowing the people to vote on the matter. We also urge Congress to use its Article III,
Section 2 power to prevent activist federal judges from imposing upon the rest of the nation the judicial activism in Massachusetts and California."

DEM FOOTNOTES

1 Obama and Biden are against a federal marriage amendment and have stated they support States defining marriage parameters. However, Obama recently sent a letter to California homosexual activists, stating that he agrees with their opposition to a statewide ballot initiative to repeal same-sex marriage that was imposed by
the California Supreme Court on May 15, 2008.

2 Obama publicly stated he would use the president’s ’bully pulpit’ to repeal the Defense of Marriage Act. He also voted against the
Federal Marriage Amendment in 2006.

3 Biden voted for DOMA in 1996; however, his current stance on
its repeal is unknown at this time.

4 Obama’s Letter to the Family Equality Council[here]

5 Obama sponsored non-discrimination for sexual orientation[here];
but there is no public statement about position on transgender rights.

6 Obama Pride Letter [here]Obama co-sponsored legislation to expand federal hate crimes laws to include sexual orientation and gender identity. See HRC’s Questionnaire [here]. He made a special trip
back to DC to cast the 60th vote in the Senate to pass hate crimes, which was vetoed by President Bush.

7 Biden publicly supports the Employment Non-Discrimination Act; however, it is not known if he approves of including transgender/gender identity.
